This End-User License Agreement (“EULA”) is a legally binding agreement between you, the end user (“you” or “User”), and Techkraft Inc. (“we,” “our,” or “us”), regarding your use of our software products and services (collectively referred to as the “Software”). This EULA governs your rights and responsibilities in relation to the Software. By installing, accessing, or using the Software, you agree to be bound by the terms of this agreement. If you do not agree to the terms of this EULA, do not install or use the Software.
1. License Grant
Techkraft Inc. grants you a non-exclusive, non-transferable, revocable, and limited license to use the Software in accordance with the terms set forth in this EULA. This license is for the sole purpose of using the Software in compliance with this agreement and any documentation provided by Techkraft Inc.
Permitted Uses:
- You may install and use the Software on the number of devices permitted by the license type you purchased.
- You may make one copy of the Software for backup or archival purposes.
Prohibited Uses:
You may not:
- Distribute, sublicense, lease, sell, or otherwise transfer the Software to any third party.
- Reverse engineer, decompile, or disassemble the Software, except as explicitly permitted by applicable law.
- Use the Software for any illegal purpose or in violation of applicable laws and regulations.
- Remove, obscure, or alter any proprietary notices, labels, or marks on the Software.
2. Intellectual Property Rights
The Software, including all intellectual property rights (such as copyrights, patents, trademarks, and trade secrets), is and remains the property of Techkraft Inc.. No title or ownership rights are transferred to you under this EULA.
Any ideas, feedback, or suggestions you provide about the Software are considered non-confidential and may be used by Techkraft Inc. without any obligation to compensate you. By providing feedback, you grant Techkraft Inc. an irrevocable, non-exclusive, royalty-free license to use, modify, distribute, and exploit the feedback.
3. Data Collection and Privacy
In connection with your use of the Software, Techkraft Inc. may collect and store certain information about you, your device, and how you use the Software. This data may include, but is not limited to:
- Personal data (e.g., name, email address) provided by you when creating an account.
- Technical information (e.g., IP address, operating system, browser type).
- Usage data (e.g., pages visited, features used).
We use this data to:
- Improve the performance and functionality of the Software.
- Provide you with personalized features and recommendations.
- Ensure compliance with legal and regulatory requirements.

4. Updates and Upgrades
We may, from time to time, release updates, patches, or upgrades to the Software. These updates may include bug fixes, enhanced features, or improvements. Techkraft Inc. reserves the right to automatically update the Software without prior notice.
You acknowledge that failure to install updates may result in reduced functionality, performance issues, or security vulnerabilities. Techkraft Inc. is not responsible for any issues arising from your failure to apply updates.
5. Support and Maintenance
Techkraft Inc. may provide technical support and maintenance services at its sole discretion. These services may include troubleshooting, installation assistance, and other support as necessary. Support services may be limited to specific versions of the Software and may require you to maintain up-to-date versions.
6. Warranties and Disclaimers
The Software is provided “as is” and “as available,” without any warranties of any kind, either express or implied. Techkraft Inc. makes no warranties, representations, or guarantees regarding the performance, reliability, or availability of the Software, including but not limited to:
- The Software meeting your specific requirements.
- The Software being error-free or free from viruses or other harmful components.
- The accuracy or reliability of results obtained through the use of the Software.
To the fullest extent permitted by law, Techkraft Inc. disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the maximum extent permitted by law, Techkraft Inc. and its affiliates, licensors, and partners shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Software, including but not limited to:
- Loss of revenue or profits.
- Loss or corruption of data.
- Business interruptions or delays.
Techkraft Inc.’s total liability under this EULA, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount paid by you for the Software during the twelve months preceding the claim.
8. Termination
This license is effective until terminated. Techkraft Inc. may terminate this EULA at any time, for any reason, including but not limited to your failure to comply with any terms of this agreement.
Upon termination:
- You must cease all use of the Software.
- You must delete or destroy all copies of the Software in your possession.
- The provisions of this EULA that by their nature should survive termination shall remain in effect (e.g., Limitation of Liability, Ownership, Data Collection, etc.).
9. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the Federal Democratic Republic of Nepal, without regard to its conflict of laws principles. Any disputes arising from or related to this EULA shall be resolved exclusively in the courts located in the Federal Democratic Republic of Nepal.
10. Indemnification
You agree to indemnify, defend, and hold harmless Techkraft Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of this EULA or your use of the Software.
11. Miscellaneous
- Entire Agreement: This EULA constitutes the entire agreement between you and Techkraft Inc. regarding the use of the Software and supersedes all prior agreements.
- Severability: If any provision of this EULA is found to be invalid or unenforceable, the remainder of the agreement will continue in effect.
- Waiver: The failure of Techkraft Inc. to enforce any provision of this EULA shall not be considered a waiver of its rights to enforce such provision in the future.
